YOU MAY BE ENTITLED TO A CASH PAYMENT FROM A CLASS ACTION SETTLEMENT IF YOU USED OR SCANNED YOUR FINGER(S) TO ENROLL IN OR CLOCK-IN OR -OUT OF WORK USING A KRONOS FINGERSCAN TIMECLOCK WHILE WORKING IN A NON-UNION POSITION FOR AMERICAN AIRLINES OR ENVOY AIR IN ILLINOIS AT ANY TIME FROM NOVEMBER 17, 2012 UNTIL AUGUST 2, 2023.

  • The court has authorized notice of a proposed settlement in a class action lawsuit, Fregoso v. American Airlines, Inc., No. 2017-CH-15328, pending in the Circuit Court of Cook County, Illinois before the Honorable Judge Neil H. Cohen. The Settlement would resolve a lawsuit brought on behalf of persons who allege that American Airlines, Inc. (“Defendant”) implemented a timekeeping system that required Defendant’s employees and Envoy Air’s employees to provide a scan of their finger or fingerprint for timekeeping purposes without complying with the Illinois Biometric Information Privacy Act, 740 ILCS § 14/1, et seq. (“BIPA”).

  • If you received notice, you have been identified as someone who may have used or scanned your finger(s) to enroll in or clock-in or -out of Defendant’s Kronos fingerscan timekeeping system while working in a non-union position for Defendant or Envoy Air in Illinois on or after November 17, 2012. The Court has granted preliminary approval of the Settlement and has preliminarily certified the Settlement Class for purposes of settlement only.
